Prevost attaches great importance to the protection of Personal Information.
In order to inform you of the privacy practices implemented in connection with its Site, Prevost has developed this Privacy Policy (the Policy), which summarizes: (i) the types of Personal Information collected and the situations that may lead to its collection; (ii) the ways in which it is used and protected; (iii) the situations in which it may be shared; and (iv) how it is stored and destroyed. This policy also describes your rights, as well as the security measures in place and the procedure applicable in the event of a breach of confidentiality. 1. DEFINITIONS AND INTERPRETATION
Capitalized terms used in this policy have the following meanings:
- Authorized Subcontractor refers to any person assisting Prevost in the development or provision of the Site and Services and who needs to know certain information (including Personal Information) in order to do so.
- Personal Information refers to information about a physical person that allows that person to be identified, directly or indirectly.
- Prevostrefers to Prevost Bus, a division of Groupe Volvo Canada.
- Services refers to all content and services available on the Site, excluding services offered on any other third-party website. Services include the supplier portal, the shipping and delivery management portal, and the Prevost Web store.
- Siterefers to the site www.prevostcar.com/fr , including all its subdomains.
- User or You refers to any person who accesses or uses the Site (including its Services), namely any member of the public and, when applicable, any Prevost customer.
Unless required otherwise by the context, grammatical variations of any defined term have the same meaning.
2. GENERAL PRINCIPLES
Personal Information collected or provided in connection with the Site is obtained, used, communicated, stored and destroyed in accordance with this Policy. Prevost may also treat such information in accordance with applicable laws and regulations, including the Act respecting the protection of personal information in the private sector .
3. COLLECTION AND USE OF YOUR PERSONAL INFORMATION
3.1 Information Provided by Users
No collection of Personal Information is required to allow You to have access and use the Site (and its Services) . You may, however, choose to provide Personal Information to Prevost. Prevost’s customers may communicate Personal Information to create an online account and to use the functionalities associated therewith.
In accordance with the law, Prevost considers that if You provide it with information, then You have consented to Prevost collecting it for the purposes for which it is obtained (or otherwise as required or permitted by law), as described in this Policy. If You refuse to provide necessary information, it may be impossible for Prevost to provide the applicable Services.
The following Personal Information may be provided by Users:
o Comments, questions and requests for information: You may choose to provide certain Personal Information (e.g. : your name and email, and your opinion/observation) if You contact Prevost to obtain information or make comments or requests. Prevost will use this Personal Information to respond to your communication.
o Content:You do not need to provide any Personal Information in order to consult the content of the Site (or use any Service). Cookies may, however, collect certain information, as further described in section 3.2.
o Employment:If You wish to apply for a job opening, Prevost will collect your contact information, as well as the information You provide, including your CV, cover letter and any other Personal Information you may provide, in order to analyze your file and communicate with you as part of the recruitment process.
o Newsletters: If You wish to subscribe to receive the latest news from Prevost, a list of events in which You may wish to participate and exclusive offers, then You may do so by providing your last name(s), first name(s) and e-mail address, and selecting the publications to which You wish to subscribe. You may unsubscribe at any time by clicking on the "Unsubscribe" option at the bottom of any email we send you. This Personal Information will be used by Prevost to send You its newsletters.
o Product orders: You may order products from the Prevost online store by providing your name, contact information, address and credit card information. This Personal Information is used exclusively to process your order and send you the products you have purchased.
We may also use the Personal Information we collect to meet legal, regulatory, insurance, security and processing requirements, and otherwise with your consent, or as permitted or required by law. Unless permitted or required by applicable laws or regulations, we will retain your Personal Information only as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting or auditing requirements. Finally, Prevost does not sell your information to third parties.
3.2 Information Obtained from Third Parties or Through Technology
When you visit our Site, we use cookies and similar tracking technologies to collect information to remember your preferences and settings as you navigate our Site. The information collected includes: your IP address, the date and time of your visit, the pages You visit, the functionalities You use, the reference URL from which You came and the one to which You go next, your browsing history (i.e. the pages you consult, the links you click on and the other actions you perform in connection with the Site), your browser type and the language you select.
We use this information to conduct internal research into our users' demographics, interests and behavior in order to better understand, protect and serve our users and our community, and to improve our services. We may use session cookies and persistent cookies. A "session cookie" expires immediately when you end your session (i.e., when you close your browser). A "persistent cookie" stores information on the hard disk, so that when You end your session and return to our site at a later date, the cookie information is still available. Cookies placed by our server are readable only by us, and cookies cannot access, read or modify other data on your computer.
We also use Google Analytics to better understand who uses our site and how people use it. Google Analytics uses cookies to collect information such as the pages of the site visited, the places where users click, the time spent on each page of the site, the Internet protocol address, the type of operating system used and your location. This information is used to target advertising and content that may be of interest to You, and to provide statistical information through features such as Google Analytics.
Many web browsers allow You to manage your preferences. You can set your browser to refuse cookies or delete some of them. You may also be able to manage other tracking technologies in the same way. In some cases, tracking tools used by third-party service providers can be disabled. For example, Google allows you to deactivate cookies used to target ads by accessing the deactivation page on its main site. Google Analytics can also be deactivated, by downloading the browser add-on available for this purpose. You can also refuse the use of cookies by other third-party suppliers by logging on to the Network Advertising Initiative's consumer deactivation page.
3.3 Automated Decision-Making
The online recruitment system used by Prevost can include selection questions to determine whether candidates possess certain predefined minimum skills for the positions being considered. Please note that if You provide a negative answer to one of the selection questions, You may be automatically excluded from the recruitment process through automatic decision mechanisms in the recruitment system. In this case, You may receive an automated message indicating that your application has been rejected.
4. COMMUNICATION
Prevost will only disclose your Personal Information with your consent or if it is legally authorized to do so, in particular in the following contexts:
- The Personal Information You provide to Prevost may be transferred to Authorized Subcontractors who provide services on our behalf (including affiliates acting in this capacity). These services may include billing and order processing, marketing, information technology, hosting and data processing services.
- As part of a business transaction, in connection with the proposed or actual financing, securitization, insuring, sale, assignment or other disposition in whole or in part of Prevost, or its business or assets, for the purposes of evaluating and/or executing the proposed transaction. Assignees or successors of Prevost, or its business or assets, may use and disclose your personal information for purposes similar to those described in this Policy.
- Disclose personal information as necessary to satisfy legal, regulatory, insurance, audit and security requirements, and otherwise with your consent, or as permitted or required by law (including as required by Canadian and foreign laws applicable to us or our service providers). Accordingly, in response to a verified request from law enforcement or government officials regarding a criminal investigation or suspected illegal activity, we may (and you authorize us to) disclose your name, city, province, telephone number, e-mail address and order history without subpoena. However, in order to balance your right to privacy with the ability to protect the community from bad actors, we will not disclose additional information to law enforcement or other government officials without a subpoena, court order or similar legal process, unless the additional disclosure of information is necessary to prevent imminent physical harm or financial loss.
5. CONSERVATION
5.1 General Rules
Any unsuccessful candidate or former employee, Prevost will destroys Personal Information as soon as possible in a confidential manner.
5.2 Hosting and International Transfers of Personal Information
In order to allow us to provide our Services and give You access to our Site, Prevost, or one of its Authorized Subcontractors, may collect, use, communicate, store or process personal information on servers located in territories other than your residence, notably in Quebec, in another Canadian province and in the United States, for the purposes described in this Policy. Please note that the privacy laws of these jurisdictions differ from Canadian and Quebec privacy laws. The reasonable measures, contractual or otherwise, that we may take to protect your Personal Information while it is being processed or handled by these service providers are subject to applicable foreign legal requirements, including lawful requirements to disclose personal information to government and law enforcement authorities in certain circumstances. By submitting your personal information or by engaging with the Site or any of its subdomains, You consent to such transfer and hosting.

6. SECURITY
6.1 Security Measures
Prevost has implemented various measures to ensure the protection of Personal Information, which are reasonable in light of, among other things, the sensitivity of the information, the purpose for which it is to be used, its quantity, distribution and medium. These measures include the following:
- Limited collection and treatment:Prevost does not request that Personal Information be provided unless it is required to render the requested Services, and Prevost does not collect or process Personal Information other than as described in this Policy or as required by law.
- Limited access: Subject to applicable laws, access to any Personal Information is granted only to those Prevost employees and representatives (and, where applicable, Authorized Subcontractors) who have a need to know, following the implementation of appropriate measures, and in accordance with applicable laws. These persons are made aware of the importance of maintaining the confidentiality of Personal Information.
- Authorized Subcontractors: Authorized Subcontractors are contractually bound to ensure the protection of Personal Information to which they have access in the performance of their duties and must comply with applicable laws.
- Security in transit:Whenever Personal Information is communicated to Prevost, an HTTPS protocol is used to transfer the information, and Secure Sockets Layer (SSL) technology protects Personal Information through server authentication and data encryption. Activation of this technology can be confirmed by looking at: (i) the browser bar, which will then display, depending on the browser, a padlock to the left of the website address (URL); and (ii) the URL or address bar of the browser, in which the first character should change from ‘’http’’ to ‘’https’’.
· Secure data centers: The Site is hosted on a secure, private platform provided by a recognized IT provider.
You are also responsible for the safety and security of your information. If You have chosen a password to access certain secure areas of the Site, You are responsible for safeguarding that password. We ask You not to share your password with anyone else. If You suspect that your password has been compromised, please change it immediately and notify us as soon as possible.
6.2 Limitations
ANY TECHNOLOGY - AS WELL AS ANY OTHER SERVICE/PLATFORM OR METHOD OF DELIVERY - IS NEVER INFALLIBLE NOR FULLY PROTECTED AGAINST UNFORESEEABLE EVENTS, CYBER-ATTACKS (AND OTHER ILLEGAL ACTS) OR FAILURES, AND USERS SHOULD BE AWARE THAT THERE IS A RISK ASSOCIATED WITH ANY TRANSMISSION (INCLUDING ELECTRONIC) OF DATA. THEREFORE, PREVOST CANNOT GUARANTEE THAT SUCH DATA (INCLUDING PERSONAL INFORMATION) WILL NEVER BE INTERCEPTED OR SUBJECT TO OTHER INCIDENTS. FURTHERMORE, EVENTS AFFECTING DEVICES AND SYSTEMS (INCLUDING THOSE LEADING TO THEIR ACCESS AND CONTROL) MAY OCCUR, AND UNWANTED COMMUNICATIONS AND INVITATIONS MAY BE RECEIVED. IF USERS RECEIVE ANY COMMUNICATION THAT APPEARS TO BE FROM PREVOST REQUESTING FINANCIAL OR OTHER PERSONAL INFORMATION, THEN SUCH USERS SHOULD REFRAIN FROM RESPONDING TO SUCH COMMUNICATION. PREVOST WILL NEVER REQUEST FINANCIAL OR OTHER INFORMATION IN THIS MANNER. USERS WHO HAVE PROVIDED PERSONAL INFORMATION IN RESPONSE TO A SUSPICIOUS COMMUNICATION, POP-UP OR WEBSITE CLAIMING TO BE AFFILIATED WITH PREVOST OR WHO HAVE EXPERIENCED ANY OF THE EVENTS DESCRIBED ABOVE SHOULD [email protected] PREVOST IMMEDIATELY.
It is also the responsibility of each individual to take reasonable steps to protect his or her Personal Information.
The Site (including the Services) may contain hyperlinks to third-party websites. Prevost is not the owner of these sites, and is not responsible for them. Therefore, Prevost does not accept any responsibility for these sites. We encourage You to review the privacy policies of these other websites before using them.
8. RIGHTS AND COMMUNICATION WITH PREVOST
8.1 Users Rights
It is important that the Personal Information we hold about you is accurate and up-to-date. Please keep us informed of any necessary changes to your Personal Information. In accordance with the law, you have the right to request access to and/or correction of the Personal Information we hold about you.
If You wish to review, verify, correct or withdraw your consent to the use of your Personal Information, You may also e-mail us at [email protected] to request access, correction or deletion of any Personal Information You have provided to us. We may not accept a request to amend information if we believe that the amendment would violate a law or legal requirement or would result in incorrect information in our records.
Before giving You access to your information, providing You with the Personal Information we hold about you, or making the requested changes, we may ask You for information to help us confirm your identity and your right to access such information. In some cases, applicable law may require us to refuse to provide You with access to some or all of the Personal Information we hold about you, or which we may have destroyed, erased or made anonymous in accordance with our legal obligations to retain records and best practices for the protection of Personal Information.
Please note that if You request deletion of Your information, we may not be able to provide You with certain Services. We will explain the consequences of deleting your information once we have received your request in order to assist you in your decision.
If we are unable to provide You with access to Your Personal Information, we will inform You of the reasons, subject to any legal or regulatory restrictions. Such restrictions may include, for example, the involvement of information about another person that would reveal their Personal Information or confidential commercial information, or information that is difficult to obtain and prohibitively expensive to obtain.

9. CHANGES TO PREVOST’S PRIVACY POLICY
This Policy is effective as of the last update date indicated below and may be revised from time to time. If we intend to use or disclose Personal Information for purposes materially different from those described in this Policy, we will use reasonable efforts to notify You, including by posting the revised Policy on our Site. Your continued provision of Personal Information or use of our Site following any changes to this Policy constitutes your acceptance of such changes.
